Turning Point response Mental Capacity Act 2005 Draft Code of Practice
(June 2006) Turning Point’s response to the mental Capacity Act 2005 Draft Code of Practice consultation. Our response focuses on a general commentary on the Code of Practice and an analysis of those chapters pertinent to Turning Point.
MDA response Mental Capacity Act 2005 Draft Code of Practice
(June 2006) The Making Decisions Alliance (MDA) is a consortium of 40 charities set up to campaign for new legislation on mental capacity and to support the implementation of the Mental Capacity Act. This response has been prepared following consultation with its members and a meeting of the MDA.
Mental Health Legislation (March 2006): The government recently announced its plan to abandon the flawed 2004 Mental Health Bill and implement changes by amending existing legislation. Nevertheless, the proposals will have a substantial impact on many people, and Turning Point has some concerns about them. Youth Matters: Next Steps (March 2006): The government consulted on the Youth Matters Green Paper in 2005. Youth Matters: Next Steps This document is its response to the consultation, and sets out proposals for young people to be implemented by 2008. Read Turning Point's summary of the document here.
"Creating Sustainable Communities: Supporting Independence" - Consultation on a Strategy for the Supporting People Programme (February 2006): Supporting People is the government's prgramme to provide housing-related support to vulnerable people. It is organised within the Office of the Deputy Prime Minister, which launched a consultation early in 2006. Read the consultation document here and Turning Point's response here.
Turning Point submission: Work and Pensions Committee inquiry into reform of incapacity benefits and Pathways to Work (February 2006): The Work and Pensions Select Committee announced this inquiry in July 2005. Its remit is "to examine the Government’s strategy to help more people who are not in work due to ill-health or disability move into employment through a reformed system of incapacity benefits and the lessons learned from the Pathways to Work pilot schemes." Turning Point's Initial Response to the Health and Social Care White Paper "Our Health, Our Care, Our Say" (January 2006): The Department of Health launched the White Paper early in 2006. It is intended to change the way health and social care services are delivered to better fit the needs of clients. Turning Point's summary of the Welfare Reform Green Paper "A new deal for welfare: Empowering people to work" (January 2006): The Department for Work and Pensions launched this Green Paper in January 2006. It seeks to change the benefits system to encourage more people to return to work. Turning Point is currently preparing a response to the consultation. Read our summary of the Green Paper here.
Turning Point's response to the consultation on the Healthcare Commission three year plan (January 2006): The Healthcare Commission launched a draft plan for adults with learning disabilities in November 2005. Turning Point's response to the Home Office Consultation on "Restructuring Probation to Reduce Reoffending" (December 2005): The Home Secretary's plans for restructuring probation were launched in 2005. Read the Home Office paper here and Turning Point's response to the consultation here.
Turning Point’s response to the consultation on the Independent Mental Capacity Act Advocates (September 2005): The IMCA is a new statutory advocacy role which is a safeguard in the decision making process for people who lack capacity. Turning Point Project on Advocacy and Good Practice (commenced July 2005): Turning Point has been commissioned by the Department of Health to provide guidance on the commissioning of advocacy services. This is intended to be a fifteen-month project. Read a description of it here.
Turning Point’s response to the consultation on “Independence, Well Being and Choice” (July 2005): The government launched the Green Paper on Social Care, "Independence, Well-Being and Choice: Our Vision for the Future of Adult Social Care in England" in 2005. Turning Point’s response to the “Bournewood” Consultation (June 2005): The Department of Health issued a consultation in 2005 on the approach to be taken in response to the judgement of the European Court of Human Rights in the Bournewood case. This concerned the hospital admission of a man who lacked the capacity to consent or object to treatment, which the Court deemed to be in contravention of the European Convention on Human Rights. Improving Service Delivery for Disadvantaged Adults (February 2005): This consultation was launched by the Social Exclusion Unit as part of the preparation for a report on the effectiveness of mainstream servcies in engaging with disadvantaged adults. The Alternative Drugs Bill (2005): The Drugs Act was passed in April 2005. Turning Point had several concerns about its provisions, and campaigned for these to be addressed by working with Drugscope to produce an Alternative Drugs Bill. Turning Point's repsonse to "Improving service delivery for young adults (16-25) with severe or multiple problems" (December 2004): The Social Exclusion Unit launched this consultation following the publication of a report called Breaking The Cycle. Several projects were carried out to reform public services to make them more accessible. This consultation was specific to young people. Read Turning Point's response to it here.
Turning Point’s response to call for views on the impact of Valuing People (Rob Grieg’s review of Valuing People) (December 2004): Valuing People is the government's strategy for improving the community inclusion of people with learning disabilities and for providing them with opportunities to lead full and independent lives. It was first launched in 2001, and in 2004, a consultation was held to assess its impact. Read Turning Point's response to the consultation here, and the government's final report here.
Turning Point’s response to the consultation on the Common Assessment Framework (November 2004): The Department for Education and Skills launched the CAF for children and young people as a part of the Every Child Matters programme. It provides a standardised method for practictioners to understand children's needs and strengths. Consultation on Delivering Equality for Disabled People (October 2004): A consultation was held by the Department for Work and Pensions in 2004 on the extension of the disability Discrimination Act to functions of public authorities. This included the introduction of a duty on all public bodies to promote equality for disabled people. Read the consultation document here and Turning Point's response here.
Turning Point's response to the Home Office consultation on "Modernising Police Powers to Meet Community Needs" (October 2004): In 2004, the Home Office launched a consultation on the development of police powers in order to inform an update on the Police and Criminal Evidence Act 1984. Turning Point’s response to the “Fairness for All: A new Commission for Equality and Human Rights” Consultation (August 2004): In 2004, the Department for Trade and Industry launched the "Fairness for All" White Paper setting out the government's proposals for the establishment of the Commission for Equality and Human Rights, which was incorporated into the Equality Bill. Turning Point’s response to the consultation “Improving the Life Chances of Disabled People: Prime Minister’s Strategy Unit” (August 2004): The Prime Minister's Strategy Unit released the "Improving the Life Chances of Disabled People" interim report in 2004. Developing a Framework for Vocational Rehabilitation (July 2004): The Department for Work and Pensions held a discussion in order to inform the establishment of its framework for vocational rehabilitation. Read the discussion paper here and Turning Point's response here.
Turning Point's Response to Paying the Price: A Home Office Consultation Paper on Prostitution (July 2004): The Home Office released the Paying the Price consultation in order to encourage debate on the issues surrounding prostitution in England and Wales. Turning Point’s response to the “Reducing Crime, Changing Lives” consultation questions (March 2004): "Reducing Crime, Changing Lives" was produced by the Home Office in January 2004. Turning Point’s Evidence to the Joint Committee on the Disability Discrimination Bill (February 2004): The Disability Discrimination Act was passed in April 2005. During its progress through parliament, Turning Point made a submission to the Joint Committee on the Disability Discrimination Bill. Response to the Healthcare Commission Consultation "Assessment for Improvement" (2004): The Healthcare Commission is the body responsible for the promotion of better quality health services. It developed a new system of assessment in 2004. Read the Healthcare Commission's reports here and Turning Point's response here.
Consultation on Delivering Race Equality: A Framework for Action (January 2004): Delivering Race Equality is the government's programme to ensure that mental health services are appropriate to the needs of Black and minority ethnic communities. Turning Point’s response to the consultation on “Choice, Responsiveness and Equity in the NHS and Social Care” (November 2003): This consultation was launched by the Department of Health in September 2003, with the aim of allowing service users, carers, providers and other stakeholders to share ideas and good practice. Turning Point's Response to Every Child Matters (September 2003): Every Child Matters is the government's programme for children and young people. Its five aims are for children to be healthy, stay safe, enjoy and achieve, make a positive contribution and to achieve economis well-being. The original consultation took place in 2003. Turning Point’s response to the Mental Health and Social Exclusion Exercise (September 2003): The Social Exclusion Unit, which is part of the Office of the Deputy Prime Minister, launched a consultation in 2003 as part of an investigation into how to reduce the levels of social exclusion among adults with mental health problems. Turning Point's Response to the National Alcohol Harm Reduction Strategy Consultation Document (January 2003): The Department of Health and the Strategy Unit jointly launched this consultation in October 2002 to help in the design of a response to the harmful effects of alcohol.
